No special laws or special judicial proceeding will be applied to crimes categorized as hate crimes. Crimes are crimes and should be punishable within appropriate ranges and adjudicated the same upon everyone. Maximum or minimum sentencing can be determined or influenced based upon intent of the perpetrator and relevant mitigating circumstances. This in itself should be satisfactory to deal with crimes of hate. There is no need for a special set of laws or double jeopardies at different government levels invoked by hate crime classifications. Instead general existing laws should be sufficiently enforced or constructed as to handle the actions of the accused as opposed to turning to mechanisms akin to thought control. |
